Summary

Nlyten Corp through the GUIDE application (“GUIDE,” “we,” “us” and “our”) provides behavioral health and wellness courses on a platform that facilitates small group peer support interactions. Privacy is extraordinarily important to us, so we have taken steps to protect your data.

This privacy policy (“Privacy Policy”) describes the information we collect and how we use and store the data that you provide to us through the GUIDE mobile application providing the services described above (collectively, the “Services”). WE DO NOT RETAIN YOUR PERSONALLY IDENTIFYING INFORMATION ON OUR SERVERS.  WE USE A THIRD PARTY SECURE PROVIDER TO VERIFY THAT YOUR ORGANIZATION PAID FOR YOU TO USE THE SERVICES, BUT YOUR ACTIVITY WITHIN THE GUIDE APP IS NOT ASSOCIATED WITH ANY OF THE PERSONALLY IDENTIFYING INFORMATION YOU GIVE TO OUR THIRD PARTY SECURE PROVIDER. OTHER THAN AN AFFILIATION WITH A SPONSORING AGENCY, NO PERSONALLY IDENTIFYING INFORMATION IS COLLECTED OR STORED ON THE GUIDE SERVERS. 

Acceptance

By using the Services, you accept the terms of this Privacy Policy as well as our Terms and Conditions.  By submitting your Personal Information to or through the Services, you consent to the collection and processing of your Personal Information as we describe in this Privacy Policy.  The Effective Date of this Privacy Policy is listed at the top of this policy. We may change this Privacy Policy from time to time either as required by law or at our own discretion.  If we make changes to this Privacy Policy, we will notify you by posting the changes with the revised date in the Services or by providing you with an in-app notification.  Your continued use of the Services following the Effective Date above constitutes acceptance of the amended Privacy Policy.  Any amended Privacy Policy will supersede any previous version of the Privacy Policy.

Information Not Collected and Retained by Us

Personally Identifying Information is required to provide our Services to you.  “Personally Identifying Information” may include but is not limited to email address and/or phone number.  Personally Identifying Information will be used by our Third Party Secure Provider to verify you are entitled to set up an account and to contact you in very limited circumstances outlined below.

Information We Collect

Some Demographic Information is required to provide our Services to you.  “Demographic Information” includes: age (range), gender, veteran status, marital status, parental status, employment field, and employment status. “Avatar Information” includes information associated with your avatar that you may input while using the Services and information about how you interact with the Services and use your device.  Neither the Demographic Information nor the Avatar Information are associated with your Personally Identifying Information.

We may review posts and comment threads to conduct quality control, address any potential safety concerns, and prevent misuse of the mobile app platform if suspicious activity is detected.  We may use aggregated data to conduct research and development efforts to improve the product for all members.

The content you input and/or upload whether from your mobile device or through a cloud-based service, including text, graphics, images, videos, GIFs, audio, audio-visual, and data files, may have identifiable information attached to them.  The content you upload may be visible and accessible to others. Although we encourage the sharing of ideas, emotions, and the personal effects of development within the app, we strongly discourage posting any Personally Identifying Information in the small group chat support platform and it is your responsibility not to share Personally Identifying Information in such non-private forums.

When you use the Services, we store, process, and transmit information in the form of statistics (log data) about how you use the Services to make recommendations, to engage, educate and inform you. In addition to this usage data, we collect device information such as information about your hardware, software, time zone, operating system, device identifiers, language, device sensors, and information about your network connections.  Remember that other members on the platform can (if you’ve posted them) view your posts, comments, and content you upload to the platform, and could then save that content outside of the GUIDE app.  We urge you to not send messages or upload content that you wouldn’t want others to save or share.

Our Services allow you to upload images to the platform and we cannot provide this Service without access to your camera or photos. You will receive an in-app permission request prior to the app accessing your camera or photos.

How We Use Information

We process Demographic Information and Avatar Information that we collect for various purposes, including: 1) To operate, provide and improve our services; 2) To ensure information security; 3) To protect you, us, and other members; and 4) To communicate with you in regards to our Services; or 5) to send notifications and updates about the Services and the courses or content you may be interested in on the Services.  You will be able to control your notifications and updates you receive on the settings screen of the GUIDE app.

We will disclose your Demographic and Avatar Information as we deem necessary to respond to a binding order of a data protection agency, subpoena, regulation, legal process, governmental request or other legal or regulatory process. 

In the event of a merger, consolidation, bankruptcy, restructuring, reorganization, sale of substantially all interests or assets, or other similar transaction we may transfer the Information we have to the subsequent owner or operator of the Services.

We process Demographic Information and Avatar Information to obtain insights for product development, research trends, business development purposes, optimization of notifications, and to improve our Services.

We process member Moderation Information to monitor and deal with inappropriate member content, which may result in us restricting the inappropriate member’s access to the Service, via issuance of a warning, suspending an account, or banning the member from using the Service at all.

GUIDE cooperates with academic institutions to validate our methods and improve our Services.  As a part of this cooperation, we will use your Demographic Information and Avatar Information to carry out research studies to improve our product and services.

GUIDE has partnered with Auth0 by Okta to store your login info – it is not stored on GUIDE servers or associated with your activities in the app. GUIDE never sells personally identifiable data, which includes email addresses and phone numbers. GUIDE never sells data that would tie your activity in the app to your personal data. GUIDE may share anonymous usage data for the purposes of improving mental health treatment and research.

Tracking Tech (anonymous profile, user interactions for suggestions, courses, etc.)

We process onboarding data, activity data, and member analytics to provide and manage the functionality that the Services offer. We use this information to send notifications and updates about the Services and the content you may be interested in on the platform or in the Services. We also use this information to send you administrative messages relating to the Services. We use this information to gather insights for product development and refinement, trends, business development purposes, improving member notifications, and to improve and enhance the Service.

Security of Your Information

We employ reasonable security measures to protect the information submitted through the Services.  However, security of information transmitted via the internet can never be guaranteed.  If any breach of security is suspected, in order to protect you and your information, we may suspend your use of the Services without notice pending any investigation.

You  are responsible for maintaining the security of your password, username, or any other form of authentication in getting access to any secure areas of any of the Services.  All information, including but not limited to small group comment threads, journal entries, and direct messaging (if applicable) is encrypted during transmission. We use SSL TLS 1.2 encryption that encodes all information for such transmissions.  Access to any information stored on GUIDE servers is protected by multi-layered security controls, including but not limited to firewalls, encryption, and passwords.

Retention Period

In general, we retain your information for as long as your account is active, or for the length of time necessary to fulfill the outcomes outlined in this Privacy Policy unless a longer or shorter duration is required or permitted by law.

Service Providers

Third Party Secure Provider.  We use the third party service provider, Auth0 by Okta, to retain any Personally Identifying Information in order to contact you in the event of the following circumstances: forgotten password, account reset, email or text communications about GUIDE Services, administrative services, quality assurance, or data aggregation. 

We may use other third party providers: 1) To facilitate our Service; 2) To provide a service on our behalf; 3) To perform Service-related activities; or 4) to analyze how the Service is being used.  Although these third party providers may have access to the information on the GUIDE servers, the reason for that access is to perform specific tasks assigned to them on our behalf. These providers are obligated not to disclose or use the information they have access to for any other purpose. 

Call and Texts

While using some of the Services, you may have the ability to tap links to phone numbers or text lines.  In those cases, the call or text is completed outside of the GUIDE app through your mobile device application.  Any call or text information is not collected or stored by the app.

Children’s Personal Data

In accordance with the Children’s Online Privacy Protection Act of 1998, this Service, and any services available from it, are not directed to users under the age of 13. If you learn that a user under the age of 13 has provided us with their personal information without having parental or guardian consent, please contact us immediately so we can take appropriate action. If we learn we collected information from a child under the age of thirteen (13), we will take the necessary steps to delete the information as soon as reasonably possible.

There are a variety of parental control protections available that can help limit access to material that is harmful to minors. Some examples include: Software-based parental controls: Many operating systems, web browsers, and mobile devices offer built-in parental control settings that can be used to restrict access to certain types of content, set time limits for device usage, and monitor online activity. Internet filtering services: There are a number of internet filtering services that can be used to block access to websites and content that may be inappropriate for children. Some of these services offer customizable filtering options based on age, content type, and other criteria. Router-based controls: Some routers offer parental controls that allow you to filter internet traffic at the network level, restricting access to certain websites and content. Third-party parental control software: There are many third-party software programs available that can be installed on a computer or mobile device to provide additional parental controls and monitoring features. It’s important to note that no parental control protection is foolproof, and it’s still important for parents and caregivers to actively monitor their children’s online activities and talk to them about responsible internet use.
